#MANINTREE MORE CHARGES IN SEATTLE TREE CLIMBING


The man who spent nearly 25 hours in a downtown Seattle tree has been charged with third-degree assault and first-degree malicious mischief.


A man who spent nearly 25 hours last week perched in a giant sequoia tree in downtown Seattle was charged Monday with first-degree malicious mischief and third-degree assault.

Cody L. Miller, 28, is scheduled to be arraigned on April 11.

In charging documents filed in King County Superior Court, prosecutors are asking a judge to issue a no-contact order banning Miller from going near the towering tree just outside the downtown Macy’s store.

Arborists estimated damage to the tree at about $7,000, prosecutors said.

Police and firefighters responded to Stewart Street and Third Avenue around 11:20 a.m. on March 22 after Miller allegedly threw an apple at someone and then climbed about 70 feet up the sequoia tree.

Police say Miller pelted police and firefighters with green seed cones and branches ripped from the tree as well as pieces of metal, prosecutors allege. Several passers-by and cars were hit by the cones, police said. One officer suffered a cut on the ear from a “rock hard” cone and two others were struck, court documents say.

During the 25 hours that Miller was in the tree, he argued with police negotiators, drew a large crowd of onlookers and earned a sizable Internet following as #ManInTree.

Miller finally climbed down Wednesday afternoon.

Deputy Prosecuting Attorney Stephen Herschkowitz wrote in court documents that the incident resulted in a response from more than 70 police officers, negotiators, crisis-response teams and four fire-engine companies.

“This caused an incalculable waste of time and services and arguably (affected) the efficacy of local law-enforcement’s reaction times to other serious calls for service around the city,” Herschkowitz wrote.

Miller’s mother, Lisa Gossett, of Wasilla, Alaska, said she had not talked to her son for about five years when a friend called saying he was on the news.

She said she could hardly recognize him.

“There are all these people out there worried about the tree, but they’re not worried about him, the human,” she said. “He’s obviously sick.”

She said Miller had been a “regular” kid with attention deficit disorder until his late teens or early 20s, when he came up to visit her in Alaska and she noticed that something was “off.”

When she straightened his room, she noticed he had knives stashed under a pillow. He warned her there was an evil “presence” in the house and while they were out to eat he insisted “everybody” was looking at him.

“I did not know it was mental illness at first,” she said during a telephone interview on Monday.

Miller then went to live with Gossett’s mother in Roseburg, Ore., she said, but his grandmother filed a restraining order against him after he said he had dreamed of killing her and accidentally set a shed on fire.

“It was the hardest thing she ever did, but she was afraid of him,” Gossett said.

Gossett said she made numerous attempts to get him help but was told there was nothing anyone could do unless he posed a danger to himself or others.

But, she said, he didn’t get any help even after he assaulted a police officer in Oregon.

“There’s nothing we can do because he’s an adult and doesn’t think he needs help,” she said. “It feels very hopeless.”

Bail was set at $50,000 on Friday for the man who is accused of perching atop a downtown sequoia tree for nearly 25 hours.

Cody Lee Miller said “Seattle police sent me to hell for climbing a tree” during his brief court appearance. He was originally scheduled to appear for a bail hearing on Thursday, but refused to leave his cell.

Miller, 28, was arrested Wednesday after he climbed down from the tree outside the downtown Macy’s where he had spent the night in a makeshift nest of branches.

Police and firefighters responded to Stewart Street and Third Avenue around 11:20 a.m. Tuesday after the man, later identified as Miller, threw an apple at someone and then climbed about 70 feet up the sequoia tree in a street median.

From there, he threw green seed cones and branches he’d ripped from the tree, prosecutors alleged in the certificate of probable cause. The police also say he threatened to throw feces.

Several passers-by and cars were hit by the cones, police said, and one officer suffered a cut on the ear from a “rock hard” cone, court documents say.

Police said the man claimed to be carrying a knife.

During the ensuing 25 hours, police said Miller ignored negotiators, and he drew a large crowd of onlookers. His antics earned him an Internet following as #ManInTree.

Miller has also lived in Alaska and Oregon, where he has a criminal record.

A spokeswoman with the Oregon Department of Corrections offender information center said Miller was sentenced to probation for two counts of assaulting an officer and a felony involving a weapon in 2013. Since then, he has violated the terms of his probation numerous times and was incarcerated from November 2014 to August 2015, she said.

A man suffered life threatening injuries Friday morning on Broadway when he reportedly grabbed a pressure washer from a clean-up crew worker and was struck in the throat by its high-pressure blast.

Seattle Fire rushed to the scene at Broadway and Thomas just before 7 AM to find a male in his mid-20s with a two-inch wound to his neck and blood covering the sidewalk. Medics worked to stop the bleeding and rushed the man to Harborview.

According to Seattle Fire radio traffic, the victim appeared to be homeless and was reportedly agitated by the workers using the high pressure hose before grabbing the pressure washer and suffering the horrific injury.

Police were called to the scene to investigate. UPDATE: SPD tells us that several witnesses to the incident have confirmed the basic details of the incident reported by CHS. Police are documenting the incident. According to an SPD spokesperson, the victim was admitted to Harborview for treatment of his injuries.

Seattle's #manintree booked into King County Jail for malicious mischief

The #manintree is a relatively new Seattle transplant who recently appeared in the Capitol Hill homeless and street community, CHS has been told.

For 24 hours, Cody, the 28-year-old man who suddenly climbed an 80-foot sequoia tree in downtown Seattle Tuesday caught the attention of the city — and beyond — until nearly as suddenly climbing back to the earth, sitting down, and eating a pear before being taken into custody Wednesday morning.

CHS is not identifying the man beyond his first name that was used by negotiators at the scene and was shouted by some in the crowds that formed to watch and said they knew him.

Cody was taken to Harborview for evaluation following the long standoff that closed streets in the area and snarled traffic. Police Wednesday said they had one previous contact with him. He was not charged in the previous incident and has no other criminal record in the area. His most recent run-ins with the law in Oregon earlier this year were related to parole violations, according to court records.

SPD spokesperson Patrick Michaud said the man was not facing any charges shortly after the Seattle tree incident ended.

“We’re more concerned about getting him the mental health (treatment) that he needs,” he said.

UPDATE 10:25 PM: So much for that. A male with the same name as #manintree has been booked into King County Jail for investigation of malicious mischief. He has not yet been charged.

He remains jailed.

The man who climbed a towering tree in downtown Seattle and refused to come down for nearly 25 hours has been booked into King County Jail on investigation of malicious mischief.
Seattle police say the 28-year-old man was taken to Harborview Medical Center for evaluation Wednesday after he clambered down from the tree outside the downtown Macy’s after spending the night in a makeshift nest of branches.
Police said his mental-health evaluation was short and medical professionals determined he could be booked into jail.
He is scheduled to make a court appearance in Seattle Municipal Court on Thursday afternoon. During the hearing, a judge is expected to determine whether there is probable cause to hold him on the misdemeanor charge.
The man had climbed near the top of the sequoia tree Tuesday morning and ignored police negotiators, drawing a huge Internet following as #ManInTree.



Citing the potential danger, police did not consider climbing the tree or taking any other action beyond trying to reason with the man to come down.
The man has lived in Oregon and Alaska.

Cody Lee Miller, the man dubbed #ManInTree on Twitter after spending 25 hours perched on a tree in downtown Seattle, was arrested in Portland last December.

Miller was hospitalized in Seattle for an evaluation after climbing down the tree Wednesday afternoon, and later arrested for malicious mischief. He was due in court Thursday, but refused to come out of his jail cell.

According to Multnomah County records, Miller was arrested in Portland on Dec. 16 for criminal mischief and disorderly conduct.

KATU's sister station in Seattle is reporting Miller may have also been involved in an incident outside a Starbucks store on E Pike Street last Saturday.

In that case, a man was taken in to custody after refusing to move from the sidewalk in front of the store, shouting about his constitutional rights and falsely identifying himself as Edward Cullen, the vampire from the "Twilight" series.
